Terms of Service
The terms that govern using this website — separate from, and not a substitute for, the signed agreement governing an actual XYBERU engagement.
1. Acceptance of these Terms
By accessing or using xyberu.com (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site. These Terms govern use of the Site itself — they are separate from, and do not replace, any signed statement of work, master services agreement, or engagement letter governing an actual XYBERU consulting engagement, which controls in the event of any conflict.
2. Who we are
The Site is operated by XYBERU Pvt Ltd ("XYBERU", "we", "us"), headquartered at ELNET Software City, TS 140 Block 2 & 9, Rajiv Gandhi Salai, Tharamani, Chennai, TN-600113, India.
3. Use of the Site
You may use the Site for lawful purposes only — to learn about our services, request a consultation, report a security incident, or engage with published research. You agree not to interfere with the Site's operation, attempt unauthorized access to any system referenced on the Site, scrape content for commercial redistribution, or submit false incident reports.
4. Intellectual property
All content on the Site — text, graphics, logos, research, and the "XYBERU" name and mark — is owned by XYBERU or its licensors and protected by applicable intellectual property law. You may view, download, and share Site content for personal, non-commercial reference, with attribution; you may not republish, sell, or represent it as your own work without our prior written consent.
5. No professional advice from Site content
Insights, whitepapers, service descriptions, and other published content are informational and reflect general practice at the time of writing — they are not a substitute for engagement-specific advice, do not create an advisory or client relationship, and should not be relied on as a complete compliance or security program for your organization. Regulatory and threat information changes; verify current requirements before acting.
6. Incident reporting channel
The incident-reporting channel is provided as a rapid-contact mechanism, not a guarantee of a specific response time absent a separate contractual SLA. Submissions are handled per our Privacy Notice; treat the channel as a starting point for engaging our response team, not a substitute for your organization's own incident response procedures.
7. Third-party links and services
The Site may link to or embed third-party services (e.g. scheduling, payment, or analytics tools). We do not control and are not responsible for third-party content, availability, or practices — review their own terms and privacy notices before use.
8. Disclaimers and limitation of liability
The Site is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. To the maximum extent permitted by law, XYBERU is not liable for indirect, incidental, or consequential damages arising from Site use; nothing here limits liability that cannot be limited under applicable law, or affects the liability terms of a separately signed engagement agreement.
9. Changes to these Terms
We may update these Terms from time to time; the "last updated" date below reflects the current version. Continued use of the Site after a change constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of India, and any dispute arising from them is subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, without regard to conflict-of-law principles.
